ARBITRATION POLICY
In-Lane and Online

1. Purpose
This policy governs the arbitration process for resolving disputes between buyers and sellers of vehicles sold at Columbia Auto Auction, located in Missouri. Arbitration ensures fairness, accuracy, and integrity in all transactions.

2. Applicable Law
This policy complies with applicable Missouri state laws, including:
- Missouri Title Laws (RSMo Chapter 301)
- Missouri Odometer Laws (RSMo Section 407.526)
- Missouri Lemon Law (only applies to new vehicles; used vehicles are generally sold "as-is" unless otherwise stated)

3. Vehicle Sale Lights
- Green Light (Ride & Drive): Eligible for arbitration on major mechanical or undisclosed issues.
- Red Light (As-Is): Sold without guarantee; arbitration not permitted unless clear misrepresentation occurred (e.g., odometer rollback, salvage title).
- Yellow Light (Limited Guarantee): Seller has disclosed limitations. Buyer may arbitrate based on stated terms.

4. Arbitration Time Frames (Missouri-Based Buyers/Sellers)
- Mechanical Issues: Must be reported within 48 hours or 100 miles from sale/delivery.
- Title Issues: Must be reported within 30 calendar days. Titles must be delivered within 30 days per Missouri law.
- Frame or Structural Damage / Odometer Discrepancies: Report within 7 calendar days.
- Emissions Issues (St. Louis area only): Must be reported within 3 business days of testing.

5. Eligible Arbitration Issues
- Undisclosed branded titles (e.g., salvage, flood, rebuilt)
- Major mechanical failure (engine, transmission, 4x4 system, etc.)
- Frame or structural damage (non-disclosure)
- Odometer rollback or discrepancy
- Total loss history or unreported insurance claim
- Airbag or safety system tampering
Cosmetic issues, minor wear, or issues consistent with age/mileage are not eligible.

6. Arbitration Process
  1. Filing: Buyer files arbitration request through [online portal/email/office] within time frame.
  2. Inspection: Auction staff or a certified third-party mechanic inspects the vehicle.
  3. Decision: Auction determines resolution based on Missouri law and auction policy.
  4. Resolution Options:
- Cancel transaction and return vehicle
- Adjust price or request seller-paid repair
- Deny claim (with documentation)

7. Fees
- Arbitration Filing Fee: $[Amount] (waived or refunded if claim is valid)
- Inspection Fee: $[Amount] (if third-party mechanic used)

8. Seller Responsibilities
- Disclose known title brands, structural damage, or major defects.
- Provide transferable Missouri title within 30 calendar days.
- Accept return or adjustment if arbitration rules in buyer's favor.

9. Buyer Responsibilities
- Inspect vehicle promptly upon pickup/delivery.
- Report eligible issues within required timeframe.
- Do not disassemble or repair vehicle before arbitration is concluded.

10. Finality of Arbitration
All arbitration decisions made by the auction are final and binding. By participating in the auction, buyers and sellers agree to abide by this policy.
